Welcome to Komal Fashion USA. In these Terms of Service (“Terms”), “Komal Fashion USA”, “we”, “us” and “our” refer to Komal Fashion USA, located at 729 Greenbriar Dr. #9, Bohemia, NY 11716, United States. We operate the website komalfashion.com and our online store, including all related content, features, products and services (together, the “Services”).
By visiting our website, placing an order, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, Refund and Exchange Policy and Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you are responsible for keeping your login details secure and for all activity on your account. Please give us accurate, current and complete information when you order or create an account.
2. Our products
We sell Pakistani and South Asian clothing and accessories for women, men and kids. We work hard to show every product accurately, but colors, embroidery and fabric texture can look slightly different on different screens. Measurements are approximate and may vary slightly because many pieces are made by hand.
Many of our outfits are one of a kind or available in very limited quantities. We may discontinue a product, change a description, or limit the quantity sold to any customer at any time.
3. Orders
Placing an order is an offer to buy. Your order is accepted when we confirm it and ship it. We may refuse or cancel any order, for example if a product is no longer available, if there is an error in the price or description, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full.
Because we ship most orders within hours, please contact us right away if you need to change or cancel an order. Once an order has shipped, it can't be cancelled, but our Refund and Exchange Policy applies.
Products are sold for your personal use and not for resale.
4. Prices and payment
All prices are in US dollars. Prices, promotions and discounts can change at any time without notice, but the price you pay is the price shown when you placed your order. Applicable sales tax is added at checkout. Standard shipping within the United States is free.
You agree that the payment information you give us is accurate and that you are authorized to use your payment method. Payment must be received before your order ships.
5. Shipping and delivery
Shipping is handled as described in our Shipping Policy. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather or other events outside our control. Ownership and risk of loss pass to you when we hand your order to the carrier.
6. Returns, exchanges and refunds
Returns, exchanges, store credit and refunds are handled only as described in our Refund and Exchange Policy.
7. Pricing and content errors
Occasionally our website may contain mistakes in product descriptions, pricing, availability or promotions. We may correct errors, update information, or cancel orders affected by an error at any time, including after you have placed your order. If we cancel a paid order because of an error, we will refund you in full.
8. Intellectual property
Everything on our website, including our name, logo, product photos, videos, text and design, belongs to Komal Fashion USA or our licensors and is protected by copyright, trademark and other laws. You may use the website only for personal shopping. You may not copy, reproduce, sell or use our photos or content without our written permission.
9. Reviews and feedback
If you send us reviews, photos, comments or suggestions, you allow us to use, publish and share them, for any purpose including marketing, without payment to you. You agree that anything you submit is honest, belongs to you, and does not break any law or anyone else's rights. We may remove any content at our discretion.
10. Third-party tools and links
Our website may include tools or links provided by third parties, such as payment providers, shipping carriers and social media platforms. We don't control these services and aren't responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.
11. Relationship with Shopify
Komal Fashion USA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Komal Fashion USA. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Komal Fashion USA, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Komal Fashion USA.
12. Privacy
Your personal information is handled as described in our Privacy Policy. Because our store is hosted by Shopify, Shopify also processes some personal information as described in the Shopify Consumer Privacy Policy.
13. Prohibited uses
You may use the Services only for lawful purposes. You may not: break any law; infringe our or anyone else's rights; harass or harm others; submit false or misleading information; send spam; upload viruses or harmful code; copy, scrape or resell any part of the Services; use bots, scrapers or automated tools to access the Services without our permission; or interfere with the security or operation of the Services. Automated agents that access the Services on someone's behalf must clearly identify themselves and must not bypass any security measures. We may suspend or close access for anyone who breaks these rules.

To the fullest extent permitted by law, Komal Fashion USA and Shopify, and our respective owners, employees, partners and service providers, will not be liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue or data, arising from your use of the Services or any product. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
16. Indemnification
You agree to defend and hold harmless Komal Fashion USA, Shopify, and our respective affiliates, employees and service providers from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of any law or the rights of others, or your use of the Services.
17. Termination
We may suspend or end your access to the Services at any time if you break these Terms. Sections that by their nature should continue, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.
18. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. You agree that any dispute will be handled in the state or federal courts located in the State of New York.
19. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and our policies are the entire agreement between you and us about the Services. We may transfer our rights under these Terms; you may not transfer yours without our written consent.
20. Changes to these Terms
We may update these Terms from time to time. The latest version will always be posted on this page with its “Last updated” date. Continuing to use the Services after changes are posted means you accept the updated Terms.
